1) Scope

These Terms and Conditions (“Terms”) govern all sales and deliveries of goods made by FELLARA MODA LTDA (“FELLARA”, “we”, “our”, “the Seller”) through our online store.
By placing an order, the customer (“you”, “the Buyer”) agrees to these Terms in full.

These Terms are governed by Brazilian law, specifically the Código Civil Brasileiro, the Consumer Protection Code (Lei nº 8.078/1990), and the General Data Protection Law (LGPD – Lei nº 13.709/2018).


2) Contract Formation

2.1 All product listings in our online store represent a non-binding offer.
A legally binding contract is formed when the Buyer places an order via the checkout page, and the Seller confirms acceptance by sending an order confirmation email.

2.2 Orders are processed immediately after confirmation. Once placed, orders cannot be canceled or modified prior to shipment.

2.3 All product images and descriptions are for illustration purposes. Minor variations in color, texture, or details are possible due to photography or screen settings.


3) Prices & Payments

3.1 All prices listed are final retail prices in the displayed currency. Prices do not include potential import duties, customs, or local taxes applicable in the customer’s country.

3.2 Payments can be made via the available payment methods displayed at checkout (e.g., PayPal, Stripe, Amazon Pay, Klarna, Credit Card, PIX, or Boleto Bancário).

3.3 International orders may be subject to exchange rate adjustments or foreign transaction fees charged by your bank or card provider — these are the responsibility of the Buyer.


4) Delivery & Shipping

4.1 Orders are shipped internationally from Brazil or partner warehouses depending on stock availability.
Delivery times vary depending on destination and carrier, typically:
• Brazil: 3–7 business days
• International: 7–20 business days

4.2 The Seller is not responsible for delays caused by customs, natural events, or incorrect address information provided by the Buyer.

4.3 If a parcel is returned due to incorrect or incomplete address, we will re-ship upon request once it returns to our facility. Refunds will only be issued after the parcel is physically received back.

4.4 If a package is refused upon delivery, the Seller reserves the right to retain 30% of the purchase price to cover logistics and customs costs.
The remaining 70% will be refunded once the goods are received in original condition.


5) Returns & Refunds

We want you to love your order!
If you are not 100% satisfied, you can request a return within 30 days of receiving your product.
• Items must be unused, unworn, and undamaged.
• The customer is responsible for return shipping costs.
• Refunds are issued within 14 days after the returned item arrives at our return center.

6) Ownership & Risk

All goods remain property of FELLARA MODA LTDA until full payment has been received.
Risk passes to the Buyer upon confirmed delivery by the carrier.


7) Warranty & Defects

7.1 We stand behind the quality of our products.
If you receive a defective or incorrect item, please contact us within 7 days of delivery at support@fellara.com with photos and order details.

7.2 We will either offer a replacement or refund, depending on availability.
Damage caused by misuse, improper care, or natural wear and tear is not covered.


8) Liability

Our liability is limited to the value of the purchased item.
We are not responsible for indirect, incidental, or consequential damages, including lost profits, shipping delays, or customs issues, except in cases of willful misconduct or gross negligence.


9) Promotions & Coupons

Promotional codes or discount coupons cannot be combined, are not redeemable for cash, and are valid only within the indicated timeframe.


10) Privacy & Data Protection

We process personal data in compliance with the Brazilian LGPD (Lei 13.709/2018).

11) Applicable Law & Dispute Resolution

All legal relations between the Buyer and Seller are governed exclusively by Brazilian law, without regard to conflicts of law.
If any dispute arises, both parties agree to the jurisdiction of the courts of São Paulo, Brazil.
